The objective is not to get stopped in the first place :)

If it does happen,
I would run up the trump flag,
put on the red hat,

You don't get to that point with such an attitude, you get arrested. You lose your fishing rights for a period of time, your boat and gear gets confiscated and sold at auction, big fines, etc.

What I said above applies to getting stopped by TEXAS GW,
the trump thing would work :) not in NY.

In 30+ years, in a major metro area, along with 9/11 security concerns,
I have been stopped a total of 4 times.
One was by my own doing, wanted to see the new high tech SAFE boats
the fish police received after 9/11, so I positioned myself to get stopped.
I was not boarded or inspected, but I did board the fish police boat
to check out the electronics and other toys they had onboard.

Another time, I was stopped by NYC Harbor patrol,
was coming back to my harbor with a load of bunker,
was doing 45 knots as I entered the channel near the harbor,
saw the police boat long before I got to channel, just kept on moving,
passed them, they light up, and chased after me.
Pulled me over, the start of the 5 mile an hour zone had changed,
I wasn't aware of that. Four officers on board the police boat,
one happened to be a fishing friend of mine, after a good laugh,
have a nice day Mr. HJ

Third time was by Statue of Liberty year after 9/11 for a security
check while we were fishing for striped bass,
never boarded or catch checked.

Fourth time was after a commercial bass fishing trip,
illegal to commercial fish for or land striped bass in my area.
So we run east, fish, run into a commercial fish dock, unload,
re ice the boat, and head back to home dock.
Got stopped by fish police running at 55 knots in an "inner coastal"
type area, missed the 5mph speed limit sign, oops.
Officer asked, told them commercial striped bass fishing, no fish on board,
officer came on board, and proceeded to dig through 2,500 pounds of ice
looking for fish, since he noticed the boat was covered in bass scales.
He found nothing, received no ticket, and off we went.

PS> people who are caught with illegal fish,
DO NOT LOSE THEIR GEAR OR BOATS OR WHATEVER.
Takes multiple repeated violations to lose your commercial license.
Transgressions of fishery rules are met with fines,
usually $50-250 per fish, depending on species and situation.
That is before, the attorney negotiates it down considerably in price.

BTW, in Texas, when you're caught with illegal marine resource, it's typically $130 per fish for rec's, and catch confiscation with fines for comm's if it's determined illegal bycatch is over a certain percentage. if you get caught twice (either side), you get arrested.

I know, I know, we're doing it wrong. at least in HJ-land we are.
Still waiting to see your 55 knot pogie boat that holds thousands of pounds of fish and nets.
Yellowfin? Metal Shark? Unlimited Hydroplane? Are you seining around with Miss Budweiser?

Bunker - 25 foot carolina skiff 200hp yamaha
top speed when new was 58 knots

Striped Bass = 25 foot Contender, outboard bracket, twin 250hp yamaha

Overseas boat (sold) = 40 foot triple 350 hp yamaha

I feel the need for speed :)

Equals more catchin time


PS> fish fines in the area are same for rec and com basically,
if they catch someone with large amount of striped bass,
an arrest is possible, most other fish, a ticket/court appearance.
Catch is confiscated from both.
I know a guy who was caught 4 times in 2 weeks, lol.

I hooked one on the Dolphin in the early 2000's that was six or so ft long. Was in January if memory serves on a 50hr. while beeliner fishing. I hooked it on a livish beeliner.

It ran then jumped a couple times then broke off. Would of liked to have had in on a bit longer but was ok with it breaking off. I wouldn't have wanted to land it but the boat sure wanted to.

I do not recognize mandates from the government that infringe on my personal liberties,
like wearing a mask, following so called fishing regulations, speed limits, etc.

Fishing the Gulf of MEXICO,
I do not recognize the US claim on this body of water,
and refer to the original territorial water boundary set forth
in the Constitution, which was set at 3 miles.
Thus, when further than 3 miles,
being in International Waters,
I do not recognize any laws or fisheries regulations imposed
by any state or regulating body of the US government.

You think they might have an issue with that? lol.

I think I could chat them up, put a smile on their face,
and off they go without an inspection. :)
Have accomplished that in VA, MA, NC, FL and British Columbia Canada.


Hypothetically, if I had some extra fish on board
and I was about to be stopped by fish police,
by the time I would be stopped those extra fish would no longer be on board.
Second hand gossip tells me, extra fish are placed in mesh laundry bags,
with a rock or sash weight enclosed,
and this parcel is tossed over before a boarding will occur.
Turn the boat, and slide over the opposite side.
Even if seen, the dumping ticket of $200 will be less than
the ticket from what was in the bag(s).

PS> from what I have heard, some boats carrying extra fish
employ this technique on the way in, all rods, gaffs and nets are placed
on the deck, all skins(fishing gear) is taken off,
and the goofy sun hats are put on,
just some putz's out for a boat ride,
no rods sticking up like dozens of antennas,
and they look to next boat.

PPS> the one other sea species besides striped bass that could
get you arrested in my area is actually Horseshoe crabs.
Get caught poaching them, they will arrest you.

A few years back, a boat was poaching them during the late NIGHT,
they were spotted by some people and they called in.
Fish police showed up, boat ran, fish police called in the real
police who sent a helicopter to chase/follow them for 8 miles,
where the finally abandoned the boat on a shoreline and ran
into the nearby woods. Made all the local news stations.

That does not sound very responsible... I am not a lover of over regulation, which many fisheries suffer from, all with mostly good intent, but still motivated by concerns other than the fishery...

HappyJack... People like you are the reason we need enforcement, you should mask your self centered attitudes on the forums before you bring the wrath of the "Do-Gooders" down on the fishing community... One of your posts says more regulation needed, next post says you don't recognize any laws or regulations... Shame shame... Whats that all about... playing both sides of the fence to stir up trouble???
